Comments on project risk transfer

Contract or agreement language

• You can include specific language in a contract
• That transfers a specific risk to the performer

  • However, only do this if the performer is in a position to influence and control the risk
  • Otherwise the transfer will likely be invalid
  • In the last analysis, the owner/sponsor usually reaps the consequences in one way or another
• The best contracts spell out the responsibilities of both parties
